Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and T&L Companies LLC, doing business as True Standard Fitness ("True Standard Fitness," "we," "us," or "our"), governing your use of our websites, mobile and web applications, and related services (collectively, the "Services"). By creating an account, purchasing a subscription, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services and to enter into these Terms. By using the Services you represent that you meet this requirement.

2. Health and medical disclaimer

The Services provide general fitness, nutrition, and wellness information and coaching, including AI-generated guidance. They are not medical advice and are not a substitute for professional medical care. Consult a qualified healthcare provider before starting any exercise or nutrition program, especially if you have a medical condition, are pregnant, or take medication. You use the Services at your own risk and are responsible for exercising within your own limits. Stop and seek medical attention if you experience pain, dizziness, or other symptoms.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

4. Subscriptions, billing, and renewals

• Plans: paid plans (for example, the TSF App at $47/month or $247/year, and VIP Coaching) are described at the point of sale. Prices may change on a prospective basis.
• Automatic renewal: subscriptions renew automatically at the end of each billing period until canceled. By subscribing, you authorize recurring charges to your payment method through our processor, Stripe.
• Cancellation: you may cancel at any time through the app's billing settings or by contacting us. Cancellation stops future renewals; access continues through the end of the current paid period.
• Refunds: except where required by law, payments are non-refundable. VIP Coaching engagements are governed by the specific coaching agreement you sign.

5. Messaging consent

If you provide your phone number and consent, you agree to receive automated informational and marketing text messages. Consent is not a condition of purchase. Reply STOP to opt out and HELP for help. Message and data rates may apply. See our Privacy Policy for details.

6. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Share your account, resell access, or scrape, copy, or redistribute our content without permission.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.
• Upload content that is illegal, infringing, harmful, or that you do not have the right to share.

7. Intellectual property

The Services, including all programs, plans, text, graphics, software, and the T.E.F. Method content, are owned by or licensed to True Standard Fitness and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use while your account is in good standing.

8. User content

You retain ownership of the content you submit (such as check-ins, logs, and photos). You grant us a license to host, process, and use that content to operate and improve the Services and to provide coaching to you. You are responsible for the content you submit.

9. AI-generated content

Parts of the Services use artificial intelligence to generate programs, meal plans, and coaching responses. AI output may contain errors and should be reviewed with common sense and, where appropriate, a professional. AI guidance does not create a professional-client relationship except where you have a signed VIP Coaching agreement.

10. Third-party services

The Services rely on third parties such as Stripe (payments), Twilio (SMS), Resend (email), and AI processing providers. Your use of those features may be subject to the third party's terms. We are not responsible for third-party services.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular fitness or health result will be achieved. Results vary by individual.

12. Limitation of liability

To the maximum extent permitted by law, True Standard Fitness and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless True Standard Fitness from claims, damages, and expenses arising out of your use of the Services, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or to protect the Services. You may stop using the Services and cancel your subscription at any time. Sections that by their nature should survive termination will survive.

15. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which T&L Companies LLC is organized, without regard to conflict-of-laws rules. You agree to resolve disputes on an individual basis and to the exclusive jurisdiction of the courts located there, unless applicable law provides otherwise.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance.
